On Sunday, August 26, 2012 at 1:26am officers responded to the report of an injury accident in the 1600 block of Tennessee Street.  Officers arrived within one minute and determined a pedestrian had been struck by a vehicle and seriously injured.

The investigation determined a vehicle had slowed and stopped in the right traffic lane on Tennessee Street, which is a one-way street running south.  This vehicle was being operated by Dustin A. Erickson, age 21, a University of Kansas student originally of Derby, Kansas.  The driver had reportedly stopped to pick up individuals from a nearby party.

As the vehicle was stopped in the roadway pedestrians crossed from the east side of the street towards the vehicle being operated by Mr. Erickson.  Individuals were entering the vehicle through the rear cargo door of the 1999 Ford Explorer as Colby J. Liston crossed the street in preparation to enter the vehicle.  Mr. Liston, an eighteen year old University of Kansas student from Derby, Kansas, was then struck by a southbound vehicle.

The moving vehicle was a 2005 Ford Explorer being operated by Julian M. Kuszmaul, a 21 year old University of Kansas student from Lawrence.  This vehicle struck Mr. Liston as he was in the street behind the stopped Explorer, crushing him between the vehicles and causing some of the occupants of the stopped vehicle to fall from the cargo area into the street.

Mr. Liston suffered critical injuries in the collision and was transported to the University of Kansas Hospital in Kansas City.  Other individuals involved received minor injuries.

Intoxicants were present in the involved parties and blood test results are pending.  Investigative reports, including test results, will be forwarded to the District Attorney’s Office when they become available.  No citations were issued at the scene.  The incident was documented under Lawrence Police Department reports #02-12-71865 and #02-12-11127.
